CHLR - Amends the Customs House Agents Licensing Regulations, 2004.

Notification No. 99/2005-Customs (N.T.) 7th November, 2005 G.S.R.653 (E).- In exercise of the powers conferred by sub- section (2) of section 146, of the Customs Act, 1962 (52of 1962), the Central Board of Excise and Customs hereby makes the following regulations the Customs House Agents Licensing Regulations, 2004, namely:- to amend 1. (1) These regulations may be called the Customs House Agents Licensing (First Amendment) Regulations, 2005. (2) They shall come into force on the day of their publication in the Official Gazette. 2. In the Customs House Agents Licensing Regulations, 2004, (hereinafter referred to as the said Regulation), - (i) in reg u la tio n 4 , fo r th e w o rd s “tw o n ew sp ap ers h avin g circulation in the area of his jurisd ictio n ,” th e w o rd s “tw o newspapers, one in English and the other in vernacular language having wide circulation in the area of his ju risd ictio n ,” sh all b e su b stitu ted ; (ii) in regulation 5, in sub-regulation (1), for the words and letter “in Fo rm A ” th e w o rd s an d letter “in th e fo rm o f letter to th e jurisdictional Commissioner of Customs, containing details as sp ecified in Fo rm A ” (iii) in regulation 8, in sub-regulation (7), in the proviso, the w o rd s “an ad d itio n al o r” sh all b e omitted.; (iv) in regulation 9,- (a) in sub-reg u latio n (3 ), fo r th e w ord s “in vo lved in ” th e su b stitu ted .; w o rd s “co n victe d sh a ll o f” b e (b) after sub-regulation (6), the following shall be inserted, namely;- “(6 A ) A n ap p eal filed b y an ap p licant under sub-regulation (4) shall be decided by the Chief Commissioner of Customs or the Chief Commissioner of Customs and Central Excise, as the case may be, with in a period of one year from the d ate o n w h ich su ch ap p eal is filed .” (v) in regulation 10, in sub-regulation(1), for the word and fig u res “R s. 5 0 ,0 0 0 /-” th e w o rd and fig u res “R s.7 5 ,0 0 0 /-” shall be substituted; (vi) in regulation 14, for the w o rd s “su ch ch an g e sh all forthwith be communicated by such licensee to the Commissioner o f C u sto m s” th e w o rd s “su ch ch an g e sh all be communicated by such licensee to the Commissioner of C u sto m s w ith in a p erio d o f sixty d ays o f su ch ch an g e.” ; (vii) in Form A, for the heading “A p p lica tio n Form for Grant of Customs H o u se A g en t’s Licen se u n d er section 1 4 6 o f th e C u sto m s A ct,1 9 6 2 .” th e h ead in g “Particu lars to be Furnished for Grant of Customs H o u se A g en t’s Licen se under sectio n 1 4 6 o f th e C u sto m s A ct,1 9 6 2 ” sh all b e substituted.
