Circular No. 73/97-Cus. Dated 32/12/97 F.No. 305/191/97-FTT Government of India Ministry of Finance Department of Revenue, New Delhi Subject: Misuse of Notification No. 8/ 97- Central Excise dt. 1.3. 1997. It has been brought to the notice of the Board that a 100% EOU has cleared cotton yarn manufactured from duty free locally procured cotton yarn and imported Poly Vinyl Acetate, to Domestic Tariff Area, by availing of the exemption notification No. 8/ 97-CE dated 1.3.97. The notification No. 8/97-CE stipulates that benefit would be available to the goods produced or manufactured in a 100% EOU, from wholly indigenous raw materials. The misuse of the notification has resulted in duty evasion to the tune of Rs. 2.6 crores. 2. You are requested to direct the field formation to be vigilant and ensure such misuse of notification does not repeat in your jurisdiction. 3. Kindly acknowledge receipt of this letter. Sd /- (O.P.
