[TO BE PUBLISHED IN THE GAZETTE OF INDIA, EXTRAORDINARY, PART II, SECTION 3, SUB-SECTION (i)] GOVERNMENT OF INDIA MINISTRY OF FINANCE (DEPARTMENT OF REVENUE) Notification No.106/2007-Customs New Delhi, dated the 25th September, 2007 G.S.R. (E). -Whereas, the designated authority vide the amendment notification No. 15/22/2006-DGAD, dated, the 30th August, 2007, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 31st August, 2007, has come to the conclusion that M/s Taiwan Pulp and Paper Corporation, Taiwan (Chinese Taipei) has violated the conditions of the price undertaking, and has recommended imposition of definitive anti-dumping duty on all exports of Potassium Carbonate by M/s Taiwan Pulp and Paper Corporation, Taiwan at the same rate as applicable to all other non-cooperative exporters from Taiwan (Chinese Taipei) as notified vide final findings notification No.14/42/2002-DGAD, dated the 16th January, 2004, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 19th January, 2004; Now, therefore, in exercise of the powers conferred by sub sections (1) and (5) of section 9A of the Customs Tariff Act 1975 (51 of 1975) read with rules 18 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the Central Government hereby makes the following further amendments in the notification of the Government of India, in the Ministry of Finance (Department of Revenue), No. 37/2004-Customs, dated the 20th February, 2004, [G.S.R. 127(E), dated the 20th February, 2004], published in Part II, Section 3, Sub-section (i) of the Gazette of India, Extraordinary, dated the 20th February, 2004, namely: - In the said NOTIFICATION, - (I) in the TABLE, - (i) against Sl.No. 1, for the entry in column (7), the entry “Any producer” shall be substituted; (ii) against Sl.No. 2, for the entry in column (7), the entry “Any producer” shall be substituted; (II) after paragraph 2, and before Explanation, the following paragraph shall be inserted, namely:- “3. The anti-dumping duty imposed under this notification on imports of all types of Potassium Carbonate, produced or exported by M/s Taiwan Pulp and Paper Corporation, Taiwan, and imported into India, shall be levied with effect from the 9th May, 2007, and shall be paid in Indian currency”.
