Notification No.113/2006-Customs 16th November, 2006 G.S.R. (E).- In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, on being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue), No. 39/96-Customs, dated the 23rd July, 1996, published in the Gazette of India, Extraordinary, vide number G.S.R. 291(E); dated the 23rd July, 1996, namely:- In the said notification, in the Table, after S.No. 30, and the entries relating thereto, the following S.No. and entries shall be inserted, namely:- (1) (2) (3) “31. The following goods, If,- required for the Airborne (a) the said goods are imported by Early Warning and authorised works centers of the Control (AEW&C) System Airborne Early Warning and Control Programme of Ministry of (AEW&C) programme, as may be Defence,- designated by an officer not below the rank of Deputy Secretary to i) aircrafts, aircraft parts, the Government of India in the aircraft engines, aircraft Ministry of Defence; and engine parts, including ground handling (b) the authorised works centre equipment of aircrafts for produces to the Joint defence use; Commissioner of Customs or the Deputy Commissioner of Customs ii) radars, ESM, CSM, or the Assistant Commissioner of RWR, CMDS, MAWS, Customs, as the case may be, at Communication and their the time of import, in each case, a related list of the said goods with their components/parts, relevant description duly certified Electronic by the Programme Director, components/boards, Programme Office AEW&C, Centre simulators and related for Air Borne System, Banglore, to hardware /software; the effect that - iii) machinery, i) the said goods mentioned in the equipments including test list are required for the purposes of equipments, instruments, the AEW&C; fitting devices, components, spares, jigs (ii) the import of the said goods and fixtures, dies, tools, mentioned in the list are moulds, accessories, raw authorized by the Ministry of materials, castings, Defence under AEW&C programme forgings, piping, tubing, and the said goods shall be used consumables, mockup only for the purpose of the AEW&C and models; programme. iv) computer hardware, Explanation. – Nothing contained in computer software, this exemption shall have effect on accessories and or after the 1st day of January, consumables. 2012”.
